In recent legislative news, a bipartisan group of U.S. senators has introduced a bill that would ban commercial octopus farming in the United States and prohibit imports of farmed octopus. The Opposing the Cultivation and Trade of Octopus Produced through Unethical Strategies (OCTOPUS) Act, sponsored by Sens. Sheldon Whitehouse (D-R.I.) and Lisa Murkowski (R-Alaska), aims to protect octopus populations and ensure ethical practices in the seafood industry. The proposed law would not only prohibit commercial octopus aquaculture operations but also impose fines on the import of commercially farmed octopus or products containing it. Importers would be required to certify that they are not importing farmed octopus, and the National Oceanic Atmospheric Administration would collect data on octopus harvest methods in trade programs under its jurisdiction.

Moving on to regulatory updates, the U.S. Department of Agriculture (USDA) Food Safety and Inspection Service (FSIS) has announced a new policy to curb Salmonella contamination in raw poultry products. The proposed rule would establish final product standards to prevent raw chicken carcasses, chicken parts, ground chicken, and ground turkey products that contain any type of Salmonella at or above 10 colony forming units from entering commerce. Additionally, any detectable level of at least one of the Salmonella serotypes of public health significance would be prohibited. The USDA is accepting comments on the proposed rule within 60 days of publication in the Federal Register, demonstrating a commitment to food safety and public health.

In the realm of litigation, a recent ruling by the Ohio Supreme Court has sparked controversy regarding consumer expectations of boneless chicken wings. In Berkheimer v. REKM, L.L.C., the court determined that a consumer could have reasonably expected boneless chicken wings to contain bones and should have guarded against it. This ruling, affirmed by both an intermediate appeals court and the high court, highlights the importance of consumer awareness and understanding of food products. The dissenting opinion criticized the majority’s decision, emphasizing the need for clarity in food labeling and consumer protection.

Furthermore, consumer lawsuits against food companies continue to raise concerns about product labeling and safety. A California woman has filed a lawsuit alleging that Meati Foods deceptively labels its products as being made from mushroom root when they are actually made from mold. Similarly, a New York consumer has filed a proposed class action against Boar’s Head Provisions Co. Inc., alleging failure to disclose Listeria contamination in its products. These cases underscore the importance of transparency and accuracy in food labeling to protect consumer health and well-being.
