Las Cruces City Council to Consider Proposed Shopping Cart Ordinance

California cities are facing a dilemma as they grapple with new state orders on how to handle homeless encampments. San Francisco has announced that it will comply with the process, but other cities are split on the issue. In Las Cruces, the City Council is set to vote on modifying ordinances related to solicitation and approving a new ordinance concerning shopping cart containment and retrieval.

Las Cruces Police Department Police Chief Jeremy Story presented the proposals during a work session in April, emphasizing the potential benefits for public safety, blight reduction, and overall quality of life for residents. While some members of the public have expressed support for the ordinances, others are concerned that they may criminalize the unhoused population, making it even more challenging for them to access permanent housing.

Nicole Martinez, the Executive Director of Mesilla Valley Community of Hope, highlighted the need for community efforts and innovative solutions to address homelessness, rather than punitive measures. She urged the City of Las Cruces to invest in programs that offer support and assistance to individuals experiencing homelessness.

Despite the public debate, state legislators did not address Governor Michell Lujan Grisham’s special session agenda items in July, including a proposed bill aimed at pedestrian safety on highways. The lack of action at the state level has raised questions about the necessity of local ordinances targeting the unhoused population.

The proposed changes to solicitation ordinances in Las Cruces are minor in nature, with the goal of ensuring enforceability while respecting constitutional rights. The city has previously revised panhandling ordinances to comply with free speech protections, following objections from the American Civil Liberties Union.

Mayor Eric Enriquez emphasized the city’s commitment to finding common ground and enhancing public safety while supporting individuals experiencing homelessness. The proposed shopping cart ordinance is a new initiative aimed at addressing concerns raised by businesses and residents regarding the presence of shopping carts in public spaces.

While the city acknowledges the need for additional infrastructure and resources to support individuals experiencing homelessness, it has taken steps to allocate funding for outreach programs, mental health services, and housing initiatives. The proposed ordinance includes provisions for businesses to prevent shopping cart theft and outlines penalties for violations.

Overall, the City of Las Cruces is working towards a comprehensive approach to addressing homelessness, combining enforcement measures with support services and housing initiatives. The ongoing debate highlights the complexities of balancing public safety concerns with the need for compassionate and effective solutions for individuals experiencing homelessness.
