Learning from the New EU Law Targeting AI: Lessons for Other Countries

Artificial intelligence (AI) is a powerful technology that is rapidly changing the way we live and work. While AI has the potential to bring numerous benefits to society, it also poses significant risks that must be carefully managed. Governments around the world are grappling with how best to regulate AI to ensure that it is safe and beneficial for everyone.

The European Union has taken a leading role in addressing the risks associated with AI. The recent implementation of the Artificial Intelligence Act marks a significant step forward in regulating AI technologies. This groundbreaking law sets requirements for different AI systems based on the level of risk they pose, with stricter regulations for systems that pose a higher risk to health, safety, or human rights.

One of the key features of the EU Artificial Intelligence Act is the list of prohibited high-risk AI systems. These include systems that use subliminal techniques to manipulate individual decisions and unrestricted facial recognition systems used by law enforcement authorities. By prohibiting these high-risk systems, the EU is taking a proactive approach to protecting the rights and privacy of its citizens.

In addition to high-risk systems, the EU Artificial Intelligence Act also sets requirements for lower-risk AI systems, such as chatbots. These systems must comply with transparency requirements, such as informing individuals that they are interacting with an AI bot and not a human. Designated EU and national authorities will monitor compliance with these requirements and issue fines for non-compliance.

The EU is not alone in its efforts to regulate AI. Other countries and international organizations are also taking steps to address the risks associated with AI technologies. The Council of Europe recently adopted the first international treaty requiring AI to respect human rights, democracy, and the rule of law. Canada is discussing the AI and Data Bill, which will set rules for various AI systems based on their risks.

In the United States, the government has proposed a number of different laws addressing AI systems in various sectors. Australia is also taking steps to regulate AI, with the government establishing an AI expert group to work on proposed legislation. These efforts demonstrate a growing recognition of the need to regulate AI technologies to ensure they are used responsibly and ethically.

While the risk-based approach to AI regulation is a good start, there is still much work to be done. Regulating diverse AI applications in various sectors is a complex task that will require collaboration between policymakers, industry, and communities. Specialized laws may be needed to address the unique ethical and legal issues raised by AI technologies in specific industries, such as healthcare.

As the use of AI continues to grow, it is essential that governments around the world work together to develop comprehensive and enforceable laws to regulate AI technologies. By taking a proactive approach to AI regulation, we can ensure that AI brings the promised benefits to society while minimizing the risks and harms associated with this powerful technology.
