Newsom signs legislation aimed at reducing smash-and-grab robberies, car thefts, and shoplifting

California Gov. Gavin Newsom signed a bipartisan package of 10 bills on Friday aimed at reducing smash-and-grab robberies and property crimes in the state. The legislation, which was signed at a Home Depot store in San Jose, includes stricter penalties for repeat offenders and individuals involved in professional reselling schemes. Newsom, along with a bipartisan coalition of state lawmakers, business leaders, and local officials, emphasized the significance of these new laws in addressing property crime in modern California history.

The issue of large-scale smash-and-grab thefts, where groups of people rush into stores to steal items in plain sight, has become a major concern in California and other states. These incidents, often captured on video and shared online, have brought national attention to the rise of retail theft in the Golden State. The new legislation allows prosecutors to combine stolen items from different victims across various counties to meet the threshold for felony grand theft, leading to harsher penalties for smash-and-grab robberies and large-scale reselling operations.

In addition to addressing smash-and-grab thefts, the legislation also focuses on cargo thefts, closing legal loopholes to prosecute auto thefts more effectively, and requiring online marketplaces like eBay to collect bank account and tax identification numbers from high-volume sellers. Retailers are now able to obtain restraining orders against convicted shoplifters, providing them with additional tools to combat theft.

While the package received bipartisan support from the Legislature, some progressive Democrats expressed concerns about certain aspects of the legislation being too punitive. State Sen. Nancy Skinner, who authored the bill on online marketplaces, emphasized the importance of taking steps to stop retail theft without resorting to mass incarceration.

Earlier this year, Newsom and fellow state Democrats worked to keep Proposition 36, a tougher-on-crime initiative, off the ballot for November’s election. They feared that the measure would disproportionately criminalize low-income individuals and those with substance issues, rather than targeting the ringleaders behind organized theft operations. Newsom warned that the ballot measure would be a setback for California, likening it to the failed War on Drugs that led to mass incarceration.

The issue of crime has posed challenges for state Democrats, who have advocated for progressive policies to reduce incarceration rates and invest in rehabilitation programs. Newsom’s administration has allocated significant funds to support local law enforcement agencies in combating crime through increased patrols, surveillance equipment, and enhanced prosecution efforts.

As concerns over retail crime and drug abuse continue to mount in California, voters are increasingly frustrated with what they perceive as a lawless environment. The California Retailers Association notes the difficulty in quantifying retail crime due to limited data sharing by stores, but proponents of tough-on-crime measures point to store closures and products being locked behind plexiglass as evidence of a crisis.

A study by the Public Policy Institute of California revealed a steady increase in shoplifting incidents in Los Angeles and the San Francisco Bay Area. The California Highway Patrol has made significant strides in recovering stolen items and arresting individuals involved in criminal activities since 2019.

In conclusion, the bipartisan legislation signed by Gov. Newsom represents a significant step towards addressing property crime in California. While the issue of crime remains complex and multifaceted, these new laws aim to provide law enforcement with the tools needed to combat theft and hold offenders accountable. As the state continues to grapple with crime-related challenges, it is crucial for policymakers to strike a balance between public safety and criminal justice reform.
